By purchasing from this website you agree to abide by its terms and conditions as noted in this document. You should read this document carefully. Please make sure you understand these terms and conditions before placing an order. If you refuse to accept them you will not be able to order via this site.
This website is provided and operated by Biscuit, and used by Emma Cassidy, sole trader (known here as the Seller), to market and sell her creative artwork. Emma can be contacted via e-mail emma.cassidy1@googlemail.com, or phone 07813712363.
Terms and Conditions will be updated from time to time. Changes will not be retrospectively applied to orders.

1) Artwork Information
All artwork offered is handmade and crafted by Emma Cassidy. Each piece of artwork is by its nature unique, with slight variations in colour and texture to be expected. Whilst care has been taken to ensure photos on the website give an accurate representation, there can be no guarantee that any electronic display of the artwork's colours is accurate. So, artwork you view on a screen may vary slightly in colour from the original.
Artwork is crafted using mixed media, mainly merino wool, feathers and acrylic paint. It is rustically framed with a protective, front, clear Perspex sheet secured by screws, or nuts and bolts. It's ready to hang. Light stability of the artwork can vary, therefore it's advisable to avoid displaying it in direct sunlight. It can also be detrimental to expose Artwork to high humidity, for example, that experienced in a bathroom.
The Artwork is never to be regarded or treated as a toy, it may contain components unsuitable for children.
Seller is not responsible for indirect or consequential damages from the use of the Website or Artwork.
2) Sales Restrictions
Currently, sales are confined to mainland UK.
Sales are restricted to consumers. Businesses wishing to purchase may do so, but not for resale, or use the artwork for commercial benefit.
You need to be over 18 years of age to place an order.
3) What you are buying
The Artwork is sold for the Buyer to display for personal enjoyment, but Buyer may not without written permission:
- Reproduce it
- Scan or copy it
- Sell reproductions
- Use it commercially
- Create derivative works
Purchasing Artwork does not transfer copyright. The intellectual property of all Artwork, photographs, and Website content (text, logos, images) remain the property of E.C. Creative Canvas. You may not use any content from this Website without prior written permission.
4) Order Processing
1. The Website uses Stripe to take your order and process payment.
2. All prices are displayed in pounds Sterling, inclusive of postage and packaging (UK only).
3. Seller reserves the right to refuse or cancel any order if:
- The Artwork is unavailable
- A pricing error has occurred
- Fraudulent activity is suspected
If payment has been taken, a full refund will be issued.
4. A full balance of payment is required prior to order dispatch.
5. Orders will be carefully packaged to protect the Artwork during transit, and normally dispatched within 2-3 working days.
6. The Customer is responsible for ensuring the delivery address is given correctly for order processing.
5) Delivery
1. An estimated delivery date will be provided via e-mail, but it's just an estimate. This is because delivery to you may be effected by an event outside of the Seller's control.
2. An order shall be regarded as completed when it is delivered to the address you provided. From that time the Artwork is your responsibility.
3. Seller will normally use Royal Mail, 48hr, tracked small parcel delivery. However, reserves the right to amend this, and in any such case will provide timely notice.
4. Please advise Seller if your parcel has not been received by the estimated delivery date. Seller will contact courier, and revert as soon as practical.
5. You can cancel an order immediately if:
a. Seller refuses to deliver (currently solely offering to deliver within mainland UK)
b. An agreed deadline is missed
If you do not have the right to cancel, Seller is open to discuss a reasonable new deadline for delivery.
6. If your Artwork arrives damaged, please contact Seller by e-mail within 48 hours. Include:
a. Photographs of the packaging
b. Photographs of the damage
c. Your order number
Seller will resolve the claim as soon as practical.
6) Returns and refunds
1. Buyer wishing to cancel an order before receiving a Dispatch Confirmation should contact Seller as soon as possible to receive a full refund.
2. As a consumer, under the current UK Consumer Contracts Regulations, you have a legal right to cancel a contract, and receive a refund. This starts from the date of the Dispatch Confirmation (the date on the e-mail sent to confirm Seller's acceptance of your order, which is the date the contract is formed). This right expires at the end of 14 days after the day you receive the artwork.
3. To cancel your contract just let Seller know you have decided to return the art. You should e-mail Emma at emma.cassidy1@googlemail.com. Please include details of your order, and your return will be effective from the date you send the e-mail.
4. Where possible, returns must be made in the original packaging taking care to ensure the Artwork's safety in transit. Customers responsibility. Your refund will be the price you paid for the Artwork.
5. Since each piece of Artwork is an original handmade item, returns are only accepted where required by Consumer Law, or by prior agreement with Seller.
6. Non-returnable Artwork specifically includes
a. Commissioned Artwork
b. Personalised Artwork
Please note that reductions to your refund will be made to take into account any damage caused to the Artwork after you took possession. Refunds will be processed after the Artwork has been safely received and inspected.
7. The delivery costs you have paid will also be refunded, up to a maximum of the Seller's original delivery cost. Any concerns, please contact Seller.
8. You will be responsible for the cost for returning Artwork, unless the reason for return is damaged or not as described.
9. You may receive advice about your legal rights in relation to Artwork damaged, or not as described from your local Citizens' Advice Bureau or Trading Standards Office.
10. To the fullest extent permitted by law, the Seller's liability shall be limited to the purchase price of the Artwork.
11. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Nothing in this policy affects your statuary rights.
7) Privacy Policy
All personal information provided will be used for the sole purpose of processing your order and associated discussion during any follow-up.
All information to be used in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
E.C. Creative Canvas respects your privacy and is committed to protecting your personal data.
When you place an order, information may be collected such as:
- Name
- Billing and Shipping address
- Email address
- Telephone number
- Payment information (processed securely by the payment provider)
- Order history
- IP address and browse information
Use of your information
The information provided by you is used to:
- Process and deliver your order
- Contact you about your purchase
- Respond to your enquiries
- Meet legal and accounting obligation
- Improve service (from appreciated, constructive feedback)
Your personal information will never be sold to third parties.
Payment details are securely processed by trusted third party payment providers. Your full payment card details are not stored.
Your information will need to be shared as necessary with trusted service providers such as:
- Delivery companies
- Payment processors
- Website hosting provider
These providers only receive the information necessary to perform their services.
Customer information is retained solely for the fulfilment of orders and to comply with legal obligations.
You have the right to:
- Access your personal information
- Request deletion of your orders
- Restrict or abstain from certain processing
- Request a copy of your personal data
